Welcome to SKILLSET STUDIO. In these Terms of Service, “we”, “us” and “our” refer to SKILLSET STUDIO.

We operate this website, online store, and related content, products, features and services (collectively, the “Services”). Our store is powered by Shopify, which helps us provide the Services to you.

These Terms of Service, together with our Privacy Policy and Refund Policy, set out the terms that apply when you browse, use or purchase from our Services.

By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Consumer Rights

Nothing in these Terms, our Refund Policy, or any other policy is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded, restricted or modified.

Australian customers may have rights under the Australian Consumer Law. New Zealand customers may have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. These rights may include remedies such as repair, replacement, refund or compensation where products do not meet applicable consumer guarantees.

2. Access and Accounts

You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order through our Services.

You may be asked to provide information such as your name, email address, billing details, payment information and delivery address. You agree that the information you provide is accurate, current and complete.

You are responsible for maintaining the confidentiality of any account credentials and for activity carried out through your account.

3. Our Products

We make reasonable efforts to display our products, descriptions, colours and designs accurately. However, colours and appearance may vary slightly depending on your device, screen settings and the production process.

Some apparel products are made to order and fulfilled by third-party printing or fulfilment providers. Minor variations in print placement, colour, sizing or product appearance can occur as part of the production process.

Please read all product descriptions, sizing information, care instructions and safety information before purchasing or using a product.

4. Orders

When you submit an order, you are making an offer to purchase the selected product or products.

We may accept or decline an order where reasonably necessary, including where a product is unavailable, there is an apparent pricing or listing error, payment cannot be processed, an order appears fraudulent, or delivery cannot be arranged.

An order is accepted when we send you an order confirmation or otherwise confirm that your order is being processed.

If we cannot accept or fulfil your order, we will contact you using the details supplied with your order and, where payment has been taken, arrange an appropriate refund.

Please review your order carefully before submitting it. If you need to change or cancel an order, contact us as soon as possible. Once production or fulfilment has started, we may be unable to make changes or accept a cancellation request. This does not affect any rights you may have under applicable consumer law.

Products are supplied for personal, household or gift use only, unless we agree otherwise in writing.

5. Prices and Payment

Prices, promotions and product availability may change from time to time. The price and currency applicable to your order will be displayed on the product page and/or at checkout before you complete your purchase.

Any applicable delivery charges, discounts or promotional terms will be shown before you place your order.

You agree to provide accurate, current and complete payment and account information. By placing an order, you confirm that you are authorised to use the payment method provided.

If there is a genuine error in the price, description or availability of a product, we may correct the error. If the correction affects an order you have placed, we will contact you and give you the option to proceed at the corrected price or cancel the order for a refund.

6. Shipping and Delivery

We currently ship to eligible addresses in Australia and New Zealand. Product availability, delivery options and shipping arrangements may vary depending on the product and delivery location.

At the date these Terms were last updated, t-shirts and hoodies are available for delivery to eligible addresses in Australia and New Zealand. Stickers and air fresheners are currently available for delivery to eligible Australian addresses only. Availability will be confirmed at checkout.

Any delivery dates or timeframes provided are estimates only and are not guaranteed. While we will take reasonable steps to fulfil orders within a reasonable time, delays can sometimes occur due to production, carrier delays, customs processing, public holidays or circumstances outside our reasonable control.

If we arrange delivery, please contact us promptly if your order is lost, damaged, incorrect or significantly delayed. Nothing in these Terms limits any rights you may have under applicable consumer law in relation to delivery.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or additional delivery costs caused by an incorrect or incomplete address supplied by you.

7. Returns, Refunds and Faulty Products

Our Refund Policy forms part of these Terms and explains how we handle returns, refunds, replacements and faulty products.

We do not offer returns or exchanges for change of mind, including where an incorrect size was selected, except where an item is faulty, does not match its description, or you have another remedy under applicable consumer law.

If you believe an item is faulty, damaged, incorrect or does not match its description, please contact us at info@skillsetstudio.com.au with your order details and clear photos where appropriate.

Please do not return an item unless we provide return instructions. In some cases, a return may not be necessary before we provide a remedy.

8. Intellectual Property

All content on our Services, including our original designs, artwork, logos, product images, text, graphics, branding and website content, is owned by or licensed to SKILLSET STUDIO and is protected by applicable intellectual property laws.

You may use the Services for personal, non-commercial purposes only.

You must not copy, reproduce, distribute, modify, publish, sell, display, create derivative works from, or otherwise use any SKILLSET STUDIO content or designs without our prior written permission.

The SKILLSET STUDIO name, logo, designs, product names and slogans may be protected by trademark, copyright or other intellectual property rights.

9. Optional Tools

We may provide access to third-party tools or services that we do not own or control.

Any use of third-party tools is at your own risk and subject to the relevant third party’s terms and policies. We are not responsible for the availability, content, operation or performance of third-party tools or services.

10. Third-Party Links

Our Services may include links to websites, content or services operated by third parties.

We are not responsible for examining or evaluating third-party websites, products, services or content. If you choose to access a third-party website, you do so at your own risk and subject to that third party’s terms and policies.

11. Relationship with Shopify

SKILLSET STUDIO is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with SKILLSET STUDIO.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and SKILLSET STUDIO, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with SKILLSET STUDIO.

12. Privacy

Your personal information is handled in accordance with our Privacy Policy, available on our website.

Because our store is hosted by Shopify, Shopify may collect and process certain personal information in order to operate and improve the Services. Information submitted through the Services may also be shared with service providers involved in processing payments, fulfilling orders, delivering products and operating the store.

13. Feedback and Reviews

If you provide feedback, reviews, suggestions, ideas, comments or other content to us, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, adapt and display that content for operating, improving and promoting our Services.

You confirm that any feedback or review you submit is accurate, lawful and does not infringe the rights of another person.

We may remove content that is unlawful, misleading, offensive, defamatory, abusive, inappropriate or inconsistent with these Terms.

We aim to keep the Services accurate, secure and available. However, we do not guarantee that the Services will always be uninterrupted, error-free, secure or available at all times.

To the maximum extent permitted by law, the Services are provided on an “as available” basis.

Nothing in this section excludes or limits consumer guarantees, warranties, rights or remedies that cannot lawfully be excluded or limited.

18. Limitation of Liability

To the maximum extent permitted by law, SKILLSET STUDIO will not be liable for indirect, incidental, special or consequential loss arising from your use of the Services.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability under consumer protection laws that apply to your purchase.

19. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as severed to the extent necessary. The remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy and any other policies expressly referred to on our website, form the entire agreement between you and SKILLSET STUDIO in relation to your use of the Services and purchases from our store.

21. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer our rights or obligations under these Terms where reasonably necessary, including as part of a sale, transfer or restructure of the business, provided this does not reduce any rights you have under applicable law.

These Terms are governed by the laws of Victoria, Australia and applicable Commonwealth laws of Australia.

Nothing in these Terms is intended to prevent a customer from relying on mandatory consumer protections that apply in the country or jurisdiction where they reside, including New Zealand consumer protection laws where applicable.

We may update these Terms from time to time to reflect changes to our business, Services, legal requirements or policies.

Any updated Terms will be posted on this page with a revised “Last updated” date. Changes will not apply retrospectively to orders already accepted by us unless required by law or agreed with you.
